					<description><![CDATA[You will need to obtain a Police Clearance certificate in order to be assist with the expungment process.

The DOJ does not deal with the public directly, you will have to work through an agency in order to get your criminal record expunged.

You will be required to submit applicable documents for the expungment process

After completing all the relevant forms, you will need to send all your documents and from there it will be submitted to the DOJ.

If the Director-General is satisfied that you meet the requirements set out in the Act, he or she will issue a certificate of expungement directing that the convictions and sentences be expunged.

&#160;

A certificate of expungement will be issued to the Criminal Record Centre of the South African Police Service.

&#160;

The Head of the Criminal Record Centre will inform you, in writing, that your conviction and sentence has been expunged.

&#160;

After your record has been expunged, you can apply for a Police Clearance Certificate that will be issued without the convictions and sentences.

										<content:encoded><![CDATA[<p data-rm-block-id="block-1">Expungment South Africa is a legal process that allows individuals to clear their criminal records. Providing them with a fresh start and improved opportunities for employment, travel, and other aspects of life. Expungment  essentially removes certain criminal convictions from an individual's record, treating them as if they never occurred.</p>
<p data-rm-block-id="block-2">If your application to have your police record expunged is successful you will no longer be considered convicted of that crime.</p>
<p data-rm-block-id="block-3">Once you have your police record expunged you can honestly tell employers and any other interested parties that you have not been convicted of a crime. The expunged criminal record will no longer show on employer background checks.</p>
<p data-rm-block-id="block-4"><strong>You have a good chance of successfully getting your police record expunged if:</strong></p>
<p data-rm-block-id="block-5">1. Ten years have gone passed since the date of the conviction of your offence.</p>
<p data-rm-block-id="block-6">2. You received a sentence of periodical imprisonment or correctional supervision as opposed to a direct prison sentence.</p>
<p data-rm-block-id="block-7">3. During the 10 years since your conviction you have not been convicted and imprisoned, without the option of a fine, for any other offence</p>
<p data-rm-block-id="block-8">4. Sentenced to the following sentences:</p>
<ul>
<li data-rm-block-id="block-9">Conviction of lesser serious crimes (for example minor charges of theft, assault, fraud etc.)</li>
<li data-rm-block-id="block-10">Politically motivated crimes</li>
</ul>
<p data-rm-block-id="block-11">5. Convicted of an offence based on race.</p>
